Funeral Audio Visual – Terms & Conditions
These terms and conditions apply to funeral live streaming, videography, photography and associated audiovisual services provided by Funeral Audio Visual.
By confirming a booking, the client agrees to the terms set out below, subject to their statutory rights.
1. Funeral Live Streaming
Service Coverage and Internet Connectivity
Funeral Audio Visual uses professional broadcasting equipment and multiple internet connections to provide reliable live streaming services.
However, live streaming relies on external telecommunications networks and internet infrastructure. Although every reasonable effort is made to maintain a continuous broadcast, occasional interruptions, buffering, reduced picture quality or temporary loss of connectivity may occur due to circumstances beyond our reasonable control.
We cannot guarantee that an internet broadcast will be completely uninterrupted or free from technical difficulties.
As an additional precaution, funeral services are recorded locally wherever technically possible. If the live broadcast experiences an interruption, the recorded service will normally be made available within 24–48 hours following our return to the office, provided a usable recording has been captured.
Recording and Camera Coverage
Camera positions, filming angles and live production decisions are determined by our professional videographers, taking account of the venue, lighting, available space and any restrictions imposed by the officiant or venue management.
We will make reasonable efforts to accommodate specific filming requests agreed before the service. However, particular shots or moments cannot be guaranteed where circumstances prevent their capture.
2. Funeral Filming, Videography and Photography
Professional Coverage
Our photographers and videographers exercise professional judgement when recording funeral services, memorial ceremonies and associated events.
We aim to capture the occasion respectfully and discreetly while working within the limitations of the venue and circumstances.
Although specific requests will be considered, we cannot guarantee the capture of every individual, moment or requested image.
Image and Video Quality
Every reasonable effort is made to produce professional-quality photographs and video recordings.
However, lighting conditions, weather, venue restrictions and other environmental factors may affect the final results.
Exact colour reproduction and identical image quality across different locations cannot be guaranteed.
Replacement Photographer or Videographer
In exceptional circumstances, including illness or unforeseen emergencies, it may be necessary to appoint a suitably experienced replacement photographer or videographer.
We will make reasonable efforts to arrange an appropriate replacement and maintain the agreed standard of service.
If we are unable to provide the contracted service, any refund or other remedy will be handled in accordance with the client's statutory rights and the circumstances of the booking.
3. Filming Permissions and Venue Restrictions
The client is responsible for informing the church, crematorium, venue or other relevant organisation that professional filming, photography or live streaming will take place.
Any necessary permissions should be obtained before the event, including permission from officiants, venue management and performers where applicable.
Some venues may impose restrictions on camera placement, microphones, lighting, movement or recording.
Funeral Audio Visual will respect these restrictions and work with venue representatives to achieve the best possible coverage.
Any additional venue charges or permission fees are the client's responsibility unless otherwise agreed in writing.
4. Copyright and Personal Use
Unless otherwise agreed in writing, copyright in photographs, films and recordings created by Funeral Audio Visual remains with Funeral Audio Visual.
Once the agreed fees have been paid, clients are granted a non-exclusive licence to download, retain, watch and share their completed photographs and recordings for personal, family and non-commercial purposes.
Commercial reproduction, resale, broadcasting or other commercial use requires prior written permission.
Any third-party music, readings, performances or other copyrighted material included in a recording remains subject to the rights of its respective copyright owners.
5. Editing and Delivery of Recordings
Live Streaming Recordings
Where a usable recording is available, funeral live streaming recordings are normally provided within 24–48 hours following our return to the office if a separate file is required.
Edited Funeral Films and Photography
Where professional editing is included, completed films and photographs may take up to six weeks to prepare, depending on the complexity of the project and our workload.
Any specific delivery deadline must be agreed in writing before the booking is confirmed.
Reviewing Completed Work
Clients should notify us of any concerns or requested corrections within 14 days of receiving their completed films or photographs.
Reasonable corrections relating to agreed requirements will be considered. Additional creative changes or editing requests outside the original agreement may incur an additional charge.
This review period does not affect statutory consumer rights.
6. Music and Copyright Licensing
Where music is included in an edited funeral or memorial film, its use must comply with applicable copyright and licensing requirements.
Clients may suggest preferred music, but we cannot guarantee that every commercially released recording can legally be incorporated into a finished film or distributed online.
Where appropriate, licensed alternative music may be recommended.
One reasonable round of music changes may be included where agreed as part of the original editing service. Further changes may incur additional charges.
7. Additional Event Coverage
Our attendance and filming times are based on the arrangements agreed when the booking is confirmed.
If the service or associated event continues beyond the agreed coverage period, additional attendance may be available subject to our schedule and agreement.
Any additional charges will be explained and agreed before extended coverage is provided.
We reserve the right to conclude our attendance once the agreed coverage period has ended, unless an extension has been arranged.
8. Additional Expenses
The agreed quotation will specify the services and equipment included in the booking.
Additional expenses not included in the original quotation may include:
- Venue access or filming permission fees
- Additional equipment or technical requirements
- Extended filming or photography coverage
- Additional editing services
- Physical media and postage
- Additional travel or accommodation where agreed
Any additional charges will be communicated and agreed before they are incurred.
9. Equipment and Technical Difficulties
Funeral Audio Visual uses professional equipment and takes reasonable precautions to minimise the risk of technical problems.
Despite these precautions, unforeseen equipment faults, power failures, venue restrictions or external network disruptions may occasionally affect service delivery.
Where reasonably possible, we will use backup equipment, alternative connections or locally recorded material to minimise the impact.
If a technical problem prevents us from providing all or part of the agreed service, we will assess the circumstances and provide an appropriate remedy in accordance with applicable consumer law.
10. Cancellation and Changes to Bookings
Changes Before Confirmation
Quotations and proposed arrangements may be amended or withdrawn before a booking is formally accepted, subject to any agreement already made.
Client Cancellations
If a client wishes to cancel a confirmed booking, they should notify Funeral Audio Visual as soon as possible.
Where a cancellation is made more than 48 hours before the scheduled service, reasonable charges may apply for work already completed and costs reasonably incurred, where permitted by law.
Cancellations within 48 hours of the scheduled service may result in higher charges where preparation has been completed, equipment or personnel have been committed, or the reserved date cannot reasonably be reallocated.
Any cancellation charge will reflect the circumstances of the booking, the costs incurred and applicable consumer protection law.
Consumer Cancellation Rights
Where a booking is made online, by telephone or away from our business premises, statutory cancellation rights may apply.
Where the client expressly requests that services begin during an applicable cancellation period, charges for work already performed may be payable in accordance with the law.
Nothing in these terms removes or restricts statutory cancellation rights.
Cancellation by Funeral Audio Visual
If we are unable to fulfil a confirmed booking due to circumstances within our responsibility, we will make reasonable efforts to provide a suitable alternative or replacement service.
Where this is not possible, an appropriate refund or other remedy will be provided in accordance with the law.
11. Events Beyond Our Reasonable Control
Circumstances beyond our reasonable control may include severe weather, major transport disruption, venue closure, power failure, telecommunications outages, government restrictions or other exceptional events.
Where such circumstances affect a booking, we will communicate with the client as soon as reasonably possible and seek a practical solution.
Depending on the circumstances, this may include rescheduling, modifying the service or providing an appropriate refund.
12. Limitation of Liability
Funeral Audio Visual will exercise reasonable care and skill in providing all contracted services.
We are not responsible for failures caused solely by circumstances outside our reasonable control where we have taken appropriate precautions and fulfilled our legal obligations.
We do not accept liability for losses that are not reasonably foreseeable or that arise from circumstances for which we are not legally responsible.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
Nothing in these terms affects the client's statutory rights under applicable UK consumer protection legislation.
13. Agreement to Terms
By confirming a booking with Funeral Audio Visual, the client acknowledges that they have been provided with these terms and conditions and agrees to the applicable contractual arrangements.
Any specific requirements, additional services or agreed variations should be confirmed in writing before the event.
